Terms of Service

These Terms of Service ("Terms") govern your access to and use of websites, web applications, SaaS platforms, and related digital services (collectively, "Services") provided by Rising Web, LLC, doing business as Rising Web ("Rising Web," "we," "us," or "our"). By engaging our Services, including custom web/app development, SaaS subscriptions, or project-based work, you agree to these Terms. If you are entering into these Terms on behalf of a company or entity, you represent that you have authority to bind that entity.

Eligibility and Acceptance

Services Description

Rising Web provides custom web and app development, SaaS platforms, and digital services on a project-based or subscription basis. Services are delivered as described in project proposals or agreements. No accounts are required. We target users primarily in the US and India, handling general customer data without processing sensitive information like health or financial details.

Payments and No Refunds

Payments are accepted via Stripe or Razorpay for one-time projects or subscriptions. All fees are non-refundable upon project start or delivery commencement. Late payments may result in service suspension.

Intellectual Property and User Content

Rising Web retains all intellectual property rights in deliverables, code, designs, and Services, including after payment. Clients receive a limited, non-exclusive license for use. You grant us a perpetual license to use any content you upload for service delivery. You must not reverse engineer, decompile, resell, or misuse Services or IP.

Prohibited Uses

Do not use Services for illegal activities, spam, infringement, or harm. We may suspend access for violations without notice.

Limitation of Liability and Warranties

Services are provided "as is" without warranties. Liability is limited to fees paid in the prior 12 months. We disclaim consequential damages. No uptime guarantees apply.

Termination

We may terminate for non-payment or violations. Upon termination, access ends; data may be deleted after 30 days.

Dispute Resolution

Any disputes arising from these Terms or Services shall first be resolved through good faith negotiations between the parties. If negotiations fail within 30 days, the parties agree to mediate in good faith with a neutral mediator selected mutually, sharing costs equally. Mediation will occur in Delaware or virtually, under standard mediation rules. If mediation does not resolve the dispute, instead of going to court, the parties agree to attempt resolution via good mouth to mouth — informal, direct negotiation and settlement conducted in good faith.
